Terms of Service

1. Acceptance of Terms

By creating an account, purchasing a Service, or using any GhostRDP product, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy and Refund Policy. If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Services

GhostRDP provides the following services, subject to these Terms:

• Windows RDP: Remote Desktop Protocol hosting services with Windows Server operating systems.
• Linux VPS: Virtual private server hosting with a choice of Linux distributions.
• Dedicated Servers: Physical server hosting with exclusive resources.
• Add-on services: Additional IP addresses, backup storage, license management, and other supplementary services.

All Services are provided "as is" and "as available," unless otherwise agreed in writing.

3. Account Terms

• Eligibility: You must be at least 18 years old and able to form a binding contract under applicable law to open an account.
• Account information: You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
• Account security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
• Multiple accounts: One account per person or organization. We reserve the right to suspend or terminate duplicate accounts.
• Identity verification: We may require identity verification at any time. Failure to comply may result in account suspension.

4. Acceptable Use

You agree not to use our Services for any of the following prohibited activities:

• Any illegal activity, including but not limited to fraud, hacking, phishing, or malware distribution.
• Sending spam, bulk unsolicited communications, or any form of email bombing.
• Network attacks, DDoS amplification, or any activity that disrupts or degrades third-party network infrastructure.
• Hosting, distributing, or linking to content that promotes hate speech, violence, or illegal activity.
• Storing or transmitting illegal content or copyrighted material without authorization.
• Attempting to circumvent, reverse-engineer, or compromise our infrastructure or other users' accounts.
• Reselling or sharing account access with third parties outside your organization.
• Using our IPs or infrastructure for any form of attribution abuse, SEO manipulation, or black-hat practices.
• Port scanning, vulnerability scanning, or any unauthorized security testing without prior written consent.

Violations of this Acceptable Use Policy may result in immediate termination of Services without refund.

5. Payment & Billing

• Pricing: All prices are listed in USD and are subject to change with 30 days' prior notice. Price changes do not apply retroactively to existing subscriptions.
• Billing cycle: Services are billed monthly or annually in advance, depending on the plan selected. All fees are non-refundable except as described in our Refund Policy.
• Payment methods: We accept cryptocurrency (BTC, ETH, XMR), credit/debit cards, and PayPal. We reserve the right to refuse certain payment methods at our discretion.
• Failed payments: Accounts with failed payments will receive a 7-day grace period. Services will be suspended if payment is not received within that period.
• Overdue accounts: Accounts overdue by more than 14 days may be terminated. All data associated with terminated accounts will be permanently deleted.
• Currency: Crypto payments are converted at the prevailing rate at the time of transaction confirmation.

6. Cancellations & Terminations

• Customer cancellations: You may cancel your Services at any time through your account dashboard or by contacting support. Cancellations become effective at the end of the current billing period.
• Termination for cause: We may suspend or terminate your Services immediately, without notice, if you materially breach these Terms or our Acceptable Use Policy.
• Termination for convenience: We reserve the right to discontinue any Service with 30 days' prior notice. In such cases, you will receive a prorated refund for the unused portion of your current billing period.
• Data on termination: Upon termination, all data associated with your account is permanently deleted within 30 days unless legally required otherwise. We are not obligated to provide data backups upon termination.

7. Intellectual Property

All content, trademarks, logos, software, and materials provided by GhostRDP are the property of GhostRDP or its licensors and are protected by intellectual property laws. You retain ownership of any content you upload or create using our Services. We do not claim any ownership rights over your data. You grant us a limited license to use your content solely for the purpose of providing the Services.

8. Disclaimer of Warranties

EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, GHOSTRDP MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION, SOFTWARE, PRODUCTS, OR SERVICES CONTAINED ON OUR SERVERS FOR ANY PURPOSE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GHOSTRDP AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Any damages arising from your use of or inability to use the Services.
• Any unauthorized access, alteration, or loss of your data.
• Any conduct or content of any third party on our infrastructure.
• Any damages exceeding the total amounts paid by you to GHOSTRDP in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless GhostRDP and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you upload or transmit through our infrastructure.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GhostRDP's primary place of business is located, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for the resolution of any disputes arising from these Terms or your use of the Services.

12. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide notice via email or a notice on our website at least 30 days before the changes take effect. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must cancel your account before the changes take effect.
